In compliance with Section (1) of Act CXI of 2011 on the Commissioner for Fundamental Rights, on 31 March 2021, the Commissioner for Fundamental Rights submitted his report to the Parliament on his activities in 2020. Simultaneously, the report has also been published on the website of the Commissioner for Fundamental Rights.

People’s Advocate Position With Regard To The Large Number Of Personal Data Of Albanian Citizens Compromised For Political Purposes
Given the concerns of a large number of citizens regarding allegations of the collection and use of their personal data by a political entity, specifically the Socialist Party of Albania, the Institution of the People's Advocate states that obtaining and using personal data of citizens by any political party is illegal, unless the citizens themselves have given a special written authorization for their use for the permitted purpose, or for other concrete cases provided by the legislation in force.

Ombudsman submits National Ordinances regarding cuts to employment benefits to the Constitutional Court for review
On April 26th, 2021 the Ombudsman of Sint Maarten, Gwendolien Mossel, after careful consideration, submitted the three national ordinances, in connection with cuts to the employment benefits of all (semi) public sector workers, to the Constitutional Court for review. The three national ordinances are: the Temporary National Ordinance Covid-19 cuts, Temporary National Ordinance to amend the terms of employment of political authorities and Temporary National Ordinance on the standardization of top incomes and adjustment of employment conditions at (semi-) public sector entities.

Ombudsman Toronto to Undertake Oversight of Toronto Police
City Council on 8 April 2021 unanimously approved the biggest change in police oversight in Toronto's recent history. It asked Ombudsman Toronto to develop a Memorandum of Understanding with the Toronto Police Services Board and the Toronto Police Service, giving the Toronto Ombudsman authority to review the fairness of Toronto Police procedures and programs.

Moratoria: Ombudsman clarifies the scope of bank loans to higher education students
The Ombudsman consulted the Secretary of State for Finance, in order to ascertain the Secretary of State for Finance's interpretation of the current version of Decree-Law no. 10-J/2020, of 26.03, and received a clarification from him, in line with the Ombudsman's interpretation, that bank loans to higher education students are included within the scope of the public moratorium.

AOC Violates ICCPR by not Separating Defendants from Prisoners in Detention; CY Urges Improvement
In order to solve prison overcrowding, the Agency of Corrections (AOC) put accused persons, who are presumed innocent, in the branch prisons of non-prison correction agencies, leading to worse detention conditions than those of actual inmates and violating the International Covenant on Civil and Political Rights (ICCPR), which states that untried persons should be separated from convicted detainees. Therefore, the CY has urged the AOC to review the situation and make improvements.
