Australia | South Australia Ombudsman investigates unreasonable shackling of prisoner in hospital

The South Australian Ombudsman investigated a complaint about the department’s treatment of a young man held in custody under the Mental Health Act 2009. 

The young man, ‘Prisoner B’, was held in shackles in the Emergency Department of the Royal Adelaide Hospital for six days. It was found that Prisoner B was not shackled in accordance with the departmental policy in hospital; that the department had acted contrary to law in failing to exercise the necessary discretion in relation to shackling Prisoner B, and that the management of Prisoner B’s custody in hospital was unreasonable.
