EUROPE | MDAC research on access to justice for children with mental disabilities

Within the framework of the project, research was conducted on the relevant existing international and European legal standards and the extent of which these are implemented in Bulgaria, the Czech Republic, Hungary, Ireland, Latvia, Lithuania, Romania, Spain and the United Kingdom.

The study also addressed key national-level barriers that children with mental disabilities face in these countries in accessing justice systems and participating effectively and safely in proceedings affecting them.

The MDAC would like to share the findings of this research, which has been summarised, analysed and published in a comprehensive suite of materials, including:

  • a summary report on the project;
  • guidance and synthesis reports on the collection and dissemination of data on access to justice for children with mental disabilities;
  • a report on international standards and findings on access to justice for children with mental disabilities in ten EU Member States; and
  • a training guide for practitioners in the administration of justice on the rights of children with mental disabilities.

The materials can be found on the MDAC website. Outputs are targeted at policy-makers, members of the judiciary, and researchers; they are available in nine project languages.

MDAC hopes that the information provided by these materials will allow to gain deeper insight into the obstacles to accessing justice for children with mental disabilities and counts on your support in taking actions to open the doors of justice to them as well as to other marginalised groups.

The MDAC (Mental Disability Advocacy Center) is an international human rights organisation based in Budapest, which advances the rights of children and adults with intellectual and psycho-social disabilities through strategic litigation, advocacy, research and monitoring worldwide. Please get in touch directly with the MDAC, with feedback, to discuss other ways that may be able to collaborate or if you can help with translating the materials into other European languages.
