En 2016 la Cámara Nacional Electoral declaró inconstitucional la prohibición de voto para las personas condenadas. A 5 años de esa sentencia, la situación no ha cambiado y aproximadamente unas 6 mil personas privadas de libertad en el ámbito federal siguen sin acceder a su derecho a sufragar. La Procuración Penitenciaria de la Nación sigue trabajando para que se realicen las modificaciones legales pertinentes e incorporar así a las personas detenidas condenadas al Padrón Electoral.
