South Africa | Remedial actions recommended by Public Protector legally binding

The Public Protector’s report on the investigation into allegations of impropriety and unethical conduct relating to the installation and implementation of security measures by the Department of Public Works and in respect of the Nkandla private residence of President Jacob Zuma in KwaZulu-Natal has provoked extensive debates among the parties affected.

The Constitutional Court now ruled in this matter that the remedial action taken by the Public Protector against President Zuma is binding and that President Zuma is supposed to comply with them (see PDF below). The Chief Justice further expressed his sentiment that “The Public Protector is one of the true crusaders and champions of anti-corruption and clean governance.”

IOI President Walters congratulates Adv. Madonsela on behalf of the IOI and the international Ombudsman community on the judgement of the South African Constitutional Court in the matter which she so passionately pursued. In his opinion this judgment gives Ombudsmen the support to enforce their findings and recommendations and ensures that they are no longer “crusaders without a sword“.
