CONTROL YUAN, TAIWAN | CY Issues Correction to Hsinchu County Government for Dereliction of Duty in Blocking Legal Residents’ Passage

A legally constructed building located on a road section in Guanxi township, Hsinchu County (hereinafter referred to as “the building”) has been placed with various barriers and obstacles in front of its entrance by perpetrators since 2020. Despite repeated petitions from the residents, the Hsinchu County Government failed to provide an appropriate response. The Control Yuan (CY) members Lin Yu-Jung and Shih Chin-Fang conducted an investigation and concluded that the Hsinchu County Government was derelict in its duties. The CY Committee on Domestic and Ethnic Affairs approved the investigation and issued a correction to the Hsinchu County Government on May 8, 2025.

The correction states that the building is a legal structure, with its building line designated and construction permit issued by the Hsinchu County Government in 1989. Therefore, residents’ rights to residence and passage should be protected. However, since 2020, various obstacles have been placed in front of the building, hindering normal passage of the residents, occupying public road space, and disrupting public traffic order.

The Hsinchu County Government made no effort to investigate the cause and instead responded passively by reporting the issues as an illegality and imposing fines. Due to this negligence, the barriers have remained in place, blocking access and occupying public road for over four years. The County Government’s inaction and passive administrative response reflects a clear failure to fulfil the responsibility to maintain public order and safeguard the rights of the people.
